A Schuylkill Haven man admitted Tuesday in Schuylkill County Court that he was intoxicated when he drove in May 2015 in the borough.
Robert T. Buck, 81, pleaded guilty to driving under the influence, with prosecutors withdrawing a charge of careless driving.
“The cops smelled alcohol on my breath,” Buck told Judge Jacqueline L. Russell.
Russell, who had been scheduled to preside over Buck’s nonjury trial, instead accepted his plea and sentenced him to spend 10 days to six months on house arrest with electronic monitoring and pay costs, a $1,000 fine, $300 to the Substance Abuse Education Fund, $50 to the Criminal Justice Enhancement Account and $160 restitution to Schuylkill Medical Center-South Jackson Street. Russell made the sentence effective on April 25.
“My main concern is that” the defendant not drive, Russell said.
Schuylkill Haven borough police alleged Buck was DUI about 5:15 a.m. May 8, 2015. Buck had a blood alcohol level of 0.162 percent, police said; the legal limit for driving in Pennsylvania is 0.08 percent.
On Monday in the county court, Janet C. Magee, 41, of Coaldale, pleaded guilty to possession of a small amount of marijuana.
Judge John E. Domalakes accepted Magee’s plea and sentenced her to serve 15 to 30 days in prison with immediate parole and pay costs, a $100 SAEF payment and a $50 CJEA payment.
Pottsville police charged Magee with possessing the marijuana on Jan. 20, 2015, in the city.
In other recent Schuylkill County Court action, Judge Cyrus Palmer Dolbin accepted guilty pleas from, and, pursuant to agreements between prosecutors and defendants, imposed the indicated sentences on, these people:
Joseph W. Nortavage, 46, of Tamaqua; DUI and driving unregistered vehicle; 48 hours to six months in prison, $575 in fines, $100 SAEF payment, $50 CJEA payment and $60 restitution to Schuylkill Medical Center-South Jackson Street. Prosecutors withdrew a charge of driving under suspension.
Ashley M. Stumhofer, 25, of Pottsville; DUI and possession of drug paraphernalia; six months probation, $300 fine, $200 in SAEF payments, $100 in CJEA payments and $60 restitution to Schuylkill Medical Center-South Jackson Street. Prosecutors withdrew charges of driving unregistered vehicle, careless driving and seat belt violation.
William A. Wallace, 26, of Frackville; harassment, false identification to law enforcement and possession of drug paraphernalia; 12 months probation, $50 fine, $100 SAEF payment and $50 CJEA payment. Prosecutors withdrew charges of terrorstic threats and simple assault.
All defendants who were sentenced must pay costs as a part of their sentences.
