Instead of taking his case to trial, a Lehigh Valley man admitted Wednesday in Schuylkill County Court that he sold heroin to an undercover police officer in July 2014 in Cass Township.
Victor M. Garcia, 36, of Bethlehem, pleaded guilty to delivery of a controlled substance and possession of a controlled substance.
“I know I did the crime, and I’m remorseful for it,” Garcia said.
Judge Jacqueline L. Russell, who had been scheduled to preside over Garcia’s nonjury trial, instead accepted his plea, ordered preparation of a presentence investigation and said she would schedule the defendant’s sentencing at a later date. She allowed Garcia to remain free on $25,000 bail pending further court proceedings, a move prosecutors did not oppose.
“I don’t see a danger of a flight risk,” Assistant District Attorney David J. Rice said.
State police at Reading charged Garcia with selling the heroin in a controlled buy to an undercover police officer at 2:14 p.m. July 31, 2014, along Route 901 in Cass Township.
Rice said Garcia sold 20 bundles, or 200 baggies, containing 4.5 grams of heroin in exchange for $1,800.
Garcia said he understood the contents and consequences of his plea and was entering it knowingly and voluntarily. He also said he had discussed the matter thoroughly with his lawyer, Alan M. Ross, Harrisburg, and that he wanted a presentence investigation prepared before he is sentenced.
